Terms for using the software
Scope of the terms
These terms apply to all use of the software provided through app.solar, including paid and unpaid features. The software is provided by IFSEK - Institute for Solar Energy Quality AB (the Publisher), and these terms govern the relationship between the software user and IFSEK. The user of the software means the company that commissions the person using the software, not the private individual (the User).
Rights to the software
The Publisher holds the intellectual property rights to the software and the information provided through the software. Product information published by product manufacturers is excluded. The User may not copy or otherwise infringe these rights.
Rights to information
The User has rights to the information the User enters into the software. The Publisher may use compilations of anonymized information entered by the User. On request, the User will be offered a free export of the information entered by the User, for example for transfer to another system. This export is provided in JSON, a standard format for structured data.
Confidentiality
The Publisher undertakes not to share information entered into the software with third parties except for sharing initiated by the User through software features, such as emails to customers.
Access to data
The User will have access to data entered into the software for at least 10 years from the date the User was last invoiced by the Publisher for use of the software. Documentation created with the software will be available to the User and the User's customer for at least 25 years from the date the documentation was shared with the customer.
Permitted use
The User may use the software to support workflows, quality-assure installations, and communicate with customers about installations sold, designed, or installed by the User. The User may not rent out or resell the software. The User also may not use the software to conduct inspection operations or otherwise quality-assure installations that were not either installed or sold by the User.
Personal data
The User must ensure that the User has the right to store the personal data entered into the software. The User must delete personal data that the User no longer has the right to store in the software. For stored personal data, the Publisher acts as the personal data processor. Payment
The User pays for the features used in the software according to the price list in force at the time. The Publisher updates the price list quarterly and communicates new prices to registered users three months before any price adjustment takes effect. Payment is monthly with 30-day payment terms. The User can see costs since the previous invoice in the software under Settings -> Information -> Manage payment information.
Software function
The Publisher provides the software as is and does not guarantee that the software is suitable for a particular purpose or free from errors. When information about software defects reaches the Publisher, remedying those defects is the software team's highest priority. The Publisher gives no guarantee for how quickly a defect can be remedied. The Publisher uses Amazon Web Services as an operating partner. This is a recognized stable operating platform, but operational problems may still occur, and the Publisher gives no guarantees regarding software availability. The Publisher performs backups in accordance with Amazon Web Services recommendations, which supports high data security. However, the Publisher cannot provide compensation if data entered into the system is nevertheless lost.
Duration of the terms
These terms apply from the time the User starts using the software and continue until further notice. The Publisher may update the terms and will then notify the User of the change 30 days in advance. If the Publisher is required to change the terms due to law or authority requirements, the change may be made immediately and the User will be informed of the change.
